Former ASU Secretary says Tabcorp needs to look at its poor jobs record
Tabcorp needs to reassess its poor corporate history of moving jobs interstate and make a greater commitment to the Victorian economy, former ASU Secretary Martin Foley, MP, told Parliament last week.
Mr Foley, who is now the Member for Albert Park, raised Tabcorp’s commitment to wages and conditions in Victoria, while speaking during the debate on The Gambling Regulation Amendment (Licensing) Bill 2008.
Mr Foley said as a publicly listed company Tabcorp could bid for a new racing licence, but it must be willing to commit to a growing and viable racing industry.
“I ask that Tabcorp and its well-known leading Victorian chief
executive officer — with its significant interstate interests and its
history of relocating a large number of Victorian jobs from Melbourne
to New South Wales in an effort to cut wages and conditions — have a
look at itself and ask itself how this behaviour has contributed to the
economy of Victoria and how it has contributed to the viability of the
racing industry,” Mr Foley said.
“Together with all other bidders, Tabcorp need have no fear of
competition in a publicly accountable and transparent decision-making
process that would deliver to the racing industry economic development,
security and jobs, and it would do so particularly in the racing
industry in regional and rural Victoria,” he said.
In April this year, current ASU Secretary Ingrid Stitt sought assurances from Tabcorp that it would retain its Melbourne workforce, following reports that jobs may be moved interstate. Tabcorp sources had been quoted suggesting the company would move its Melbourne headquarters and taking hundreds of jobs interstate after the Victorian Government announced changes to its licensing arrangements from 2012.
TABCORP EBA 2007 Meetings of all Operators
Following on from the recent resolution voted on by Operators across On Course, Account Sales and Retail, your Negotiating Committee met with TABCORP on Wednesday the 10th of October to communicate to TABCORP your decision to reject the Company’s offer.
The ASU and your Delegates have now made significant improvements to the offer previously put to all Operators.
The ASU and your Delegates would now like to update all Operators on this revised offer. Which will include:

A revised wage increase offer
-
Retention bonus.
-
Maintenance of all existing condition, that are not prohibited content.
TABCORP have agreed to 30 minute paid time meetings and you will be advised as to which meeting you are to attend.
Saturday the 20th of October.
It will be vital that all Operators attend this meeting as we will be conducting a vote at this time.

TABCORP EBA 2007 - The Company targets Sessional Rates and redundancy entitlements!
The ASU and your Delegates met with TABCORP on Tuesday the 7th of August. At this meeting TABCORP management presented their “wish list” and responded to the ASU Log of Claims tabled at the previous EBA meeting.

As well as general claims across TABCORP the ASU made some specific claims on behalf of all On Course Operators:
On Course.
Increase in Metropolitan Travel allowance to $20.00 per ticket.
Increase in Country Travel allowance. Increase to .65 cents per Kilometre per Operator and the way it is paid to Operators.
Issuing of replacement uniforms on an annual basis (or where uniforms are damaged on a needs basis), to include those uniforms previously purchased by Operators themselves.
Country Operators to be given accommodation in Melbourne during Spring Racing Carnival.
Yet in response to your reasonable claims for a fair wage increase and maintenance of employment conditions the company have sought major changes to all Operators conditions of employment.
TABCORP are offering a 3% pay increase each year and in return is seeking the following concessions from all Operators:
Move all Operators from a sessional rate of pay to an hourly rate of pay. TABCORP have not outlined what this hourly rate of pay will be or how it will be calculated, however they have indicated that many factors will play a part in determining this rate of pay. The ASU made it clear that Operators will be opposed to moving to an hourly rate. TABCORP have undertaken to provide more information at the next meeting.
Removal of redundancy provisions TABCORP have indicated that they want to remove redundancy protection from the EBA and just rely on the TABCORP wide policy for all Course Operators. The TABCORP policy does not contain the same conditions as the current EBA redundancy provision. This would remove any safe guard from work in the On Course area dropping by more than 25%. Thus the company could continually drop the amount of work an Operator has each year without triggering the EBA redundancy provisions.
Travel Allowance – the Company is only prepared to raise allowances by the minimal amount previously determined by the Fair Pay Commission. Each EBA the ASU and your Delegates have sought fair increases to this allowance
Uniform replacement – TABCORP have advised that during the next 12 months they will be introducing a new and expanded dress code. We have sought more information and told TABCORP that they should pay for any changes to uniform requirements.
Compulsory Race Meetings – TABCORP are seeking to expand the number of days that are compulsory for Operators to attend to include Country Race meetings. Also TABCORP want the named days removed from the EBA and they wish to advise all Operators on a yearly basis which days are Compulsory. These may change from year to year and may expand in numbers significantly. The ASU have advised TABCORP that this is not acceptable.
TABCORP are seeking to remove the one for one replacement clause from the EBA. The Company would like the ability to replace staff as they leave instead of each September.
Overall TABCORP is seeking significant trade offs for a paltry 3% wage offer.
Any move to an hourly rate of pay may see a drop in the earning for Operators. The removal of redundancy provisions would mean there would be no compensation in the form of redundancy payments to those Operators adversely affected by a drop in work.
Now is the time to send a message to TABCORP that Operators will not stand for the loss of conditions and that Operators deserve a decent wage increase to keep pace with the cost of living.

Tabcorp EBA 2007
The TABCORP EBA expires on the 30th of June 2007. During the past couple of months the ASU and your Delegates have undertaken the massive task of surveying the majority of Operators in Account Sales, Retail, and On Course to find out the priorities members want to get out of the upcoming EBA.
All responses have now been collated across all three areas of the business and the proposed claim formalised.
The claim to be put to TABCORP based on the outcomes of your survey results is as follows:Framework Agreement
Workchoices Agreement Claims
7% per year with a 3 year Agreement.
Maintain all existing EBA conditions which are not prohibited
Incorporate all Award conditions into EBA which are not prohibited
Increase all allowances
Improved clauses providing for consultation with employees.
Increase Unpaid Annual Leave entitlement to 12 weeks per year.
Paid Parental Leave – 6weeks paid entitlement.
Paid Bereavement Leave
Free Flu Vaccinations for employees covered by the Agreement.
Annual Hearing and eye test for employees covered by Agreement.
Account Sales.
Increase flexibility around start and finish times for Operators.
High Value Operators to be paid an additional allowance of $2.00 per hour on top of the hourly rate of pay.
On Course.
Increase in Metropolitan Travel allowance to $20.00 per ticket.
Increase in Country Travel allowance. Increase to .65 cents per Kilometre per Operator and the way it is paid to Operators.

Shortages to be removed from pay sheets and to be dealt with directly by manager on the raceday for collection.
Option not to work all or part of the Spring Racing Carnival.
Retail.
Each Operator to staff no more than one terminal.
Uniforms to be replaced on an Annual basis (or where uniform has been damaged on a needs basis).
Improved clauses providing for consultation with employees.
Keep yourself informed.
A key part of the EBA negotiations is ensuring all Operators are kept informed of what is happening. Our communication will be vital during this time. Keep yourself updated by reading all bulletins and attending meetings if required.
Your Delegates will also play a key role in the EBA process, not only negotiating but making sure you are kept informed after each meeting as to where things are at with the negotiations.

Only as a united and collected group will we be in the best possible position to secure these wins for all Operators.

Three New Delegates in Tabcorp Account Sales
The ASU recently called for nominations for new Delegates in Account Sales. This is in preparation of the upcoming EBA negotiations.

We need Health and Safety Reps in Account Sales
The role of Health and Safety representative is vital in ensuring that TABCORP continues to be a healthy and safe place to work. A health and safety rep consults with colleagues, raises any health and safety issues with management and ensures a satisfactory outcome is achieved.
Training is provided to ensure that you have the appropriate skills and knowledge of the health and safety rights and responsibilities to enable you perform your role.

Tabcorp On Course Changes to the Workplace Relations Act the impact on Operators
As you will all no doubt be aware the Howard Government has made many changes to the workplace relations Act. These changes have the potential to impact on your working life with TABCORP.
Given your EBA is due to be re-negotiated in July next year, it is vital that you are aware of exactly what these changes are and the effect they will have on you, in the next round of EBA negotiation.
Branch Secretary, Ingrid Stitt, will speak about the changes and the need to be a united and strong workplace to ensure Operators continue to make gains in wages and conditions in your workplace.
Meetings will be held for all Operators at the following times for you to be updated. Meetings will be held prior to the commencement of the race day (1 hours prior to your start time):
Caulfield Race Course - Concourse
2nd of September 2006.
Flemington Race Course – The Paddock
9th of September 2006.
Come along and keep yourself updated in preparation for next years EBA. You will also have the opportunity to raise any other local issue.
